Dedicated Consumer Law Attorneys Committed to Securing Maximum Compensation for Owners of Defective Vehicles

In Oakland, a vehicle is almost necessary, and dealing with a defective vehicle is a frustrating ordeal that poses numerous challenges. First, a malfunctioning vehicle directly impacts your mobility and convenience. Relying on public transportation or alternative means can disrupt daily routines, be it commuting to work, running errands, or managing family commitments. And the unpredictability of when the vehicle might break down adds a layer of constant anxiety.

Financially, the repeated costs of repairs can be burdensome. Even if repairs are covered under warranty, there may be associated costs like renting a car during the downtime. And if the vehicle’s problems persist post-warranty, the expenses can escalate rapidly. The vehicle’s resale value can also take a hit due to its repair history, further exacerbating financial losses.

The time lost in dealing with a defective vehicle is also considerable. Frequent visits to the service center, long waits for parts or repairs, and the time spent advocating for yourself with dealerships or manufacturers can be exhausting. Emotional stress compounds as you juggle between hope for resolutions and frustrations from recurring issues.

Finally, safety concerns loom large. Defective vehicles can pose real dangers on the road, not only to the drivers but also to fellow motorists. The combination of financial, time, emotional, and safety challenges makes dealing with a defective vehicle a daunting experience.

If you recently purchased a vehicle and have spent more time in the repair shop than you’d like to recount, you may have a Lemon on your hands. The Oakland Lemon Law attorneys at Wirtz Law APC are here to help. Our experienced lawyers have handled countless claims on behalf of vehicle owners. Not only that, we’ve had great success recovering compensation on behalf of our clients in more than 98 percent of the cases we handle.

What Is the California Lemon Law?

The California Lemon Law, officially known as the Song-Beverly Consumer Warranty Act, provides vital protection to anyone who purchased or leased new or used vehicles in the state. Essentially, this legislation identifies vehicles with substantial defects or non-conformities, which the manufacturer or dealership cannot rectify after a reasonable number of attempts, as “lemons.” These defects must substantially impair the vehicle’s use, value, or safety.

If a vehicle is determined to be a lemon, the consumer may be entitled to either a replacement vehicle or a refund, with the choice resting with the consumer. The law’s protection extends through the duration of the manufacturer’s original warranty period. However, it’s worth noting that issues reported during this period might still serve as the basis for a valid Oakland Lemon Law claim, even if the coverage period has since ended.

For a vehicle to qualify under this law, the manufacturer or its agents should have had a reasonable number of attempts to address the defect. While the definition of “reasonable” can vary, it generally only needs to be at least two times. Or, if vehicles remains unrepaired after being in the repair shop for over 30 days also meets the criteria. Additionally, used vehicles still under the manufacturer’s new car warranty are also covered by this law when they are purchased under a certified pre-owned (CPO) warranty.  It’s crucial for consumers to maintain detailed records of repairs and communications with the manufacturer to build a strong case under the California Lemon Law.

How Does the Lemon Law Work?

The California Lemon Law is a consumer protection law designed to ensure that buyers and lessees of vehicles receive fair treatment and compensation when they purchase a defective vehicle, otherwise known as a “lemon.”

Below are a few of the need-to-knows if you are thinking about filing an Oakland Lemon Law claim.

What Types of Vehicles Are Covered Under the CA Lemon Law?

The CA Lemon Law covers new and used (CPO) vehicles sold or leased in California that come with a manufacturer’s new car warranty. While it predominantly focuses on new vehicles, used vehicles purchased with a CPO that are still under the original manufacturer’s warranty are also protected. In this context, “vehicle” refers to almost all types of cars, pick-up trucks, minivans, full-size vans, SUVs, and some motorhomes.

What Makes a Vehicle a Lemon?

A vehicle is typically considered a lemon if it has a substantial defect that the manufacturer or its agents couldn’t fix after a reasonable number of repair attempts. Additionally, minor defects are generally not covered by the Lemon Law, as a defect must significantly affect the use, value, or safety of the vehicle. You should consult our experienced lemon law attorneys to evaluate whether your defects are substantially impairing. Such defects might include persistent mechanical problems, bad computers, faulty brakes, or recurring electrical issues, bad transmissions, misfires, cooling systems, heating and air conditioning problems, and any other part or system of the car that has a defect in materials or workmanship.

How Does the Lemon Law Define a Reasonable Number of Attempts?

One of the key aspects of an Oakland Lemon Law claim is determining what constitutes a “reasonable” number of repair attempts. Though there’s no fixed number, it has to be more than one, so at least two attempts are needed. An experienced Oakland Lemon Law attorney at Wirtz Law APC can discuss the various ways to establish your eligibility under the law.

What Remedies Are Available to Owners Who Successfully Bring an Oakland Lemon Law Claim?

Under the California Lemon Law, consumers who have purchased or leased a “lemon” vehicle are entitled to specific remedies:

Refund: The consumer can opt for a refund from the manufacturer. This refund would include the vehicle purchase price, taxes, registration, and other official fees. It might also encompass incidental expenses like rental car costs due to the vehicle’s unavailability. However, the manufacturer is allowed to make a deduction for the vehicle’s use before its first repair attempt.

Replacement: The manufacturer can provide the consumer with a new, comparable vehicle that replaces the defective one. This new vehicle should be the same make and model, with all the options and dealer-installed accessories that the original vehicle had.

Legal Costs: If consumers successfully pursue a claim, they may also be entitled to have their attorney’s fees and costs covered by the manufacturer.

Civil Penalties: The Lemon Law also provides for the payment to you of civil penalties if you can establish that the automaker or distributor willfully failed to buy back or replace the vehicle. Here, if the automaker or distributor did not act in good faith, it may have to pay an additional amount of damages called civil penalties, equal to as much as two times your actual damages. The purpose of civil penalties is to punish the willful conduct and hopefully discourage future failures to comply with the law.

When Can You File a Lemon Law Claim in California?

Protection under the Lemon Law applies for the duration of the manufacturer’s original warranty period. However, it’s important to note that defects reported within this timeframe can still be actionable after this period, provided the attempts to repair them started within the warranty or specified time/mileage. An experienced Oakland Lemon Law lawyer at Wirtz Law APC is available to assist vehicle owners in determining their eligibility.

Can a Vehicle Manufacturer Refuse to Honor a Lemon Law Claim?

If a manufacturer refuses to honor the remedies provided by the California Lemon Law, consumers have the right to take legal action. Many consumers seek the guidance and representation of attorneys who have extensive experience in Lemon Law cases, such as those at Wirtz Law APC. In many cases where the consumer is ultimately successful, the manufacturer is required to pay the consumer’s legal fees.

Which Type of Warranty Matters for an Oakland Lemon Law Claim?

When you buy a new vehicle, it will come with at least two different types of warranties. While you are free to purchase additional warranties from the dealer, all new cars come with at least a bumper-to-bumper warranty and a powertrain warranty. Either of these manufacturer sponsored warranties may be relevant to your Lemon Law claim, depending on the type of issue your vehicle is experiencing. Dealership provided extended service contracts do not count for lemon law in California.

What Do Powertrain Warranties Cover?

Powertrain warranties cover the essential components that propel your vehicle, providing protection against defects and malfunctions in these critical systems. Specifically, a powertrain warranty typically covers:

Engine: This includes internal parts such as pistons, camshaft, timing chain, and crankshaft. It also covers seals, gaskets, and other components critical for engine function.

Transmission: Both manual and automatic transmissions are covered, encompassing their internal components, seals, gaskets, and torque converters.

Drivetrain: This pertains to either front-wheel, rear-wheel, or all-wheel drive systems, including the differential, axles, and driveshafts.

It’s worth noting that while powertrain warranties cover these major mechanical components, they usually exclude regular wear-and-tear items like clutches or items requiring routine maintenance.

What Do Bumper-to-Bumper Warranties Cover?

Bumper-to-bumper warranties, often referred to as comprehensive or basic warranties, provide broad coverage for most of a vehicle’s parts and systems. Specifically, a bumper-to-bumper warranty typically covers:

Electrical Components: Such as power windows, lights, instrument panels, and electronic modules.

Infotainment and Navigation Systems: Including radios, touchscreens, and related electronic components.

Air Conditioning and Heating Systems: Including compressors, condensers, and blower motors.

Safety Features: Such as airbags, seat belts, and advanced driver-assistance systems.

Seals and Gaskets: Important for preventing leaks.

Suspension Components: Like struts, control arms, and bushings.

However, these warranties usually exclude routine maintenance items (like oil changes and tire rotations), wear-and-tear parts (like brake pads and wiper blades), and cosmetic defects.

How Long Is My Vehicle’s Warranty?

From a legal standpoint, car manufacturers aren’t obligated to offer a new car warranty. Yet, to stay ahead in the competitive market, every major automaker opts to provide one. While some manufacturers extend more comprehensive warranties than others, a superior warranty doesn’t inherently signify a superior vehicle. Nevertheless, owners or lessees of vehicles with extended warranties have an extended window to submit a claim under the Lemon Law.

Typically, new vehicles come with a powertrain warranty that lasts between 50,000 to 100,000 miles or five to ten years, whichever comes first. Bumper-to-bumper warranties don’t usually last as long because they offer more comprehensive coverage. Most bumper-to-bumper warranties last between 36,000 and 60,000 miles or three to five years, whichever comes first.
