How Does the California Lemon Law Work?

Under the Song-Beverly Consumer Warranty Act (the California Lemon Law), automakers are required to promptly buy back your defective car or truck. Your vehicle may qualify for repurchase when the automaker has not repaired your vehicle under warranty after a reasonable number of attempts.  The lemon law also applies to used vehicles, as long as you’ve presented it for repair during the original warranty or Certified Pre-Owned (CPO) warranty period.

To qualify for a repurchase, the defects must substantially impair the use, value or safety of your vehicle. There is also no requirement under California’s lemon law for a vehicle to have the same repeated defect. If you have repeatedly brought your car in for repairs for any of the following defects, it might qualify as a lemon.

If the dealer cannot repair your vehicle after a reasonable number of attempts (which can be as few as two), the manufacturer must replace or repurchase your vehicle.

How Much is My Lemon Law Claim Worth?

If your car is a lemon, the manufacturer must either replace your defective vehicle with a brand new one or buy back your vehicle. The manufacturer is also required to reimburse you for incidental and consequential costs (e.g. , the cost of renting a vehicle or towing) you incurred while the dealer was attempting to repair your vehicle.

In addition, if we can prove that the manufacturer willfully violated the California Lemon Law, the manufacturer may also be required to pay you a civil penalty of up to two times your actual damages. The automaker is also responsible for paying your attorneys’ fees and costs, which means you pay nothing to us until we win your claim.

There are also steps you can take to protect yourself. Keep copies of all repair bills, maintain records of any incidental expenses, and document all communications with the dealer and/or manufacturer.
